✦ OUR SERVICES

In order for SolvePay to effectively fulfill its duties and keep its promise with its members, the SolvePay team will ask you to provide personal information such as your full name, among other necessary personal details that will enable us to effectively discharge our service to you as an active member, without delay. SolvePay's Privacy Policy describes in detail how we use the personal information we collect from members, and how such data is protected.

The security and protection of our members' personal information is of top priority to us at SolvePay, and your information will only be used in accordance with the terms of this Privacy Policy. We will not sell, rent or disseminate our members' personal information to third parties unless it is necessary and is in accordance with our policy. For example, as described in Information Security below, there are certain circumstances in which parts of your information will be shared with third parties, under strict restrictions, making it important for you to review this Privacy Policy in details.

This Privacy Policy applies to all services that are directly under the control of SolvePay and it's parent company IUPABS Ltd. (or its subsidiaries and affiliated partners offering third party services). By accepting the Privacy Policy and Terms of Use upon registration, you express consent to our use and disclosure of your personal information in the manner described here. This Privacy Policy is incorporated into, and subject to the SolvePay Terms of Use.

Your personal information will be stored and processed on SolvePay's computers and its server in North America. The laws on holding personal data in North America may be less stringent than the laws of your country, but SolvePay will hold and transmit your personal information in a safe, confidential and secure manner. If you object to your personal information being transferred or used as described in this Privacy Policy, please do not register to use the services of SolvePay.

✽ DISCLAIMER

SolvePay's website may include links to third party partners or affiliates' websites. Under no circumstances shall SolvePay be liable or responsible for the contents, actions or operations of these websites. Neither IUPABS Ltd, nor any of its subsidiaries will be held liable for the actions of these websites, including but not limited to, their information practices. Their privacy statements govern their respective sites.

➤ NOTIFICATION OF CHANGES

SolvePay reserves the right at any time to change, amend or update the contents of this Privacy Policy. At the same time, SolvePay promises to always notify our members via e-mail regarding any update, amendment or update to the contents of this Privacy Policy. Holders of closed accounts may still receive e-mails from SolvePay. However, all personal information is automatically deleted from our archives after 90 days of closure. Upon this time, members will no longer receive communication from SolvePay. If we are going to use or disclose your personal information in a way that is deemed different from what is explained here (e.g. due to a court order), you will be notified.
Any changes will be effective immediately and all members will be binded by it.

SolvePay will also post any changes to our Privacy Policy to our website so that you can always review the information we gather, how we might use that information, and whether we will disclose it to third parties or not. We recommend that you regularly check SolvePay's website for any updates in our Privacy Policy.

✦ INFORMATION WE COLLECT

➤ REQUIRED INFORMATION

Before becoming an active member of SolvePay, you will need to register with us and provide your full name, company name (if any), contact address, phone number, and e-mail address. In order to effectively use the services of SolvePay online, it is necessary for you to provide either credit card, debit card or bank account information. For your account safety on our platform, SolvePay requires that during registration you must choose three security questions called Personal Identification Questions (PIQs). Answers to all three PIQs must be provided at the same time. Upon account verification, whenever a member wishes to login into their SolvePay account, he/she will be required to always answer one of the PIQs correctly in order to access his/her account. The PIQ for logging in will be randomly chosen from the three selected during registration. These security questions help SolvePay to verify the owner of the account.

If any member forgets his/her password or the answers to their Personal Identification Questions, they will be given the opportunity to recover their password and/or security answers by providing to us the exact information that was submitted during the registration process for the specific account. Upon verification that the information provided is accurate, the member will then be given the opportunity to reset his/her password in order to regain access to his/her account. SolvePay will then issue a new password for the account. This process is aimed at protecting you from credit card fraud or identity theft. Once again, SolvePay only collects information that is required for the purposes stated in this policy. All information collected from our members are deemed necessary in order for us to successfully process transactions. In addition, all information collected from our members will always be treated with a high level of care and sensitivity that such information requires.

If you choose to register or apply for certain optional features or products offered by SolvePay, you will be required to provide additional information to establish that you qualify for such features or products.

➤ TRANSACTION INFORMATION

Anyone using SolvePay's services to send or receive funds, or request funds from another member, will be required to provide information related to each transaction. Such information includes the monetary value of the transaction, as well as the e-mail address of the third party involved. SolvePay retains this information for each transaction. We also collect the Internet address (IP address) of the computer or device you use to access your SolvePay account, in order to help detect possible occurences of unauthorized transactions.

➤ VERIFYING INFORMATION WITH THIRD PARTIES

In order to protect all our customers against potential fraud, we verify the information you provide to us with third parties. In the course of such verification, we receive personal identifiable information about you from such services. For example, if you register a credit or debit card with SolvePay, we may use card authorization and fraud screening services to verify that the card information and address matches the information that you provided to SolvePay, and that the card has not been reported as lost or stolen.

If you incur a debt to SolvePay, we will conduct a credit check on you by obtaining additional information about you from a credit bureau to the extent permitted by law. SolvePay, at its sole discretion, reserves the right to periodically retrieve and review a business or consumer credit report for any account, and reserves the right to close an account based on information obtained during this credit review process.

➤ ADDITIONAL VERIFICATION

If we cannot verify the information that you provide, or if you request a withdrawal by cheque or money order to an address other than your verified physical address, we may ask you to send us additional information (such as your drivers license, credit card statement, and/or a recent utility bill or other information linking you to the applicable address), or to answer additional questions online to help verify your information.

➤ WEBSITE TRAFFIC INFORMATION

As a result of standard internet communication procedures, whenever a member logs in to SolvePay's website, we automatically receive the IP address and the user's login location. We also collect information on which pages of our website you visit while you are on the SovePay site, the type of browser you use, as well as the number of times you access our website. We may use this information only to try to better understand our customer's preferences and to manage the load on our servers, as we attempt to improve our services and your experiences with SolvePay.

➤ USE OF COOKIES

Cookies are small data files that reside on your computer and allow us to recognize you as a SolvePay member anytime you return to the SolvePay site using the same computer and browser. We send a session cookie to your computer whenever you log in to your SolvePay account. These cookies allow us to recognize you if you visit multiple pages on our site during the same session, so that you do not need to re-enter your password multiple times. Once you log out or close your browser, these session cookies expire and no longer have any effect.

In addition, we use cookies to process our referral program, described in The Use and Disclosure of Information below. We may also share cookie information regarding whether a certain user is already registered with SolvePay with certain merchants with whom we have an official co-marketing relationship.

➤ CUSTOMER SERVICE CORRESPONDENCE

If you correspond with us via phone, email, Live Chat or regular post, we may retain such information in the records of your account. We may retain these records in order to measure and improve our customer service, and to investigate potential fraud and violations of our Terms of Use. We may, over time, delete these records as deemed fit.

➤ QUESTIONNAIRES, SURVEYS & PROFILE DATA

From time to time, we may offer optional questionnaires and surveys to our members for the purpose of collecting demographic information or assessing user interests and needs. The use of information collected will be explained in detail in the survey itself. If we collect personal identifiable information from our members in these questionnaires and surveys, the members will be given notice of how the information will be used prior to their participation.

While conducting independent audits of our financial statements and operations, our auditors may seek to contact a sample of our members to confirm that our records are accurate. However, these auditors are forbidden from using personal identifiable information for any secondary purposes.

➤ NON-MEMBER RECIPIENTS AND REQUESTS

SolvePay's services are available to anyone, anywhere in the world. In a situation where an active SolvePay member sends funds to a non-member, the non-member will be required to register on SolvePay.com in order to gain access to the funds sent to him/her. By registering for our services, SolvePay will collect all personal information provided, to be used in ways outlined in this Privacy Policy.

✦ The Use and Disclosure of Information

➤ DISCLOSURE TO FELLOW MEMBERS

If you are a registered SolvePay member, your name, e-mail address, account type and verification status may be displayed to other SolvePay members whom you have paid or who are attempting to pay you via SolvePay. Your credit card number, bank account and other financial information will never be revealed to anyone whom you have paid or who has paid you through SolvePay. The ONLY exception to this is if we are required to do so pursuant to a subpoena or other legal requirement.

SolvePay may also disclose to other SolvePay members the number of payments a merchant has received from Verified SolvePay customers (as defined in the Terms of Use), or other aggregate measures that provide an indication of the merchant's reputation with other SolvePay members.

➤ COMMUNICATION WITH MEMBERS

We communicate with members on a regular basis via e-mail to provide requested services. We also communicate via phone to resolve customer complaints or investigate suspicious transactions. We use your e-mail address to confirm the registration of a SolvePay account, send you notice of payments that was sent or received through SolvePay (including referral payments described below), to send information about important changes to our products and services, as well as to send notices and other disclosures as required by law. Generally, users cannot opt out of these communications, as they will be primarily informational in nature rather than promotional. However, we may occasionally use e-mail addresses to send other types of communications such as tips, newsletters, customer surveys, and notice of special third-party promotions.

➤ YOUR USE OF INFORMATION OBTAINED FROM OUR SERVICES

By entering into our Terms of Use, you agree that, with respect to other user's personal identifiable information that you obtain through the site or through a SolvePay-related communication or SolvePay-facilitated transaction, you will only use this information for:
1. SolvePay-related communications, which do include unsolicited commercial messages
2. Accessing services offered by SolvePay and
3. Any other purpose that the member agrees to after adequate disclosure of the purpose(s).

In all cases, you must provide members with the opportunity to remove themselves from your database and review any information you have collected about them. In addition, under no circumstances, except as defined in this Section, can you disclose personal identifiable information about another SolvePay member to any third party without our consent and the consent of such member. Note that law enforcement personnel and other rights holders are given different rights with respect to the information they can access.

SPAM

SolvePay does not tolerate unsolicited commercial e-mail (spam). Therefore, you may not add a SolvePay user to your mailing list (e-mail or physical mail) without them expressing consent after adequate disclosure, even if the member has previously made a purchase from you. Our anti-spam policy is strictly enforced. Any SolvePay-related spam should be reported to us.

✦ Information Security

SolvePay handles our members' information with high standards of information security. Employees of SolvePay have received detailed training to ensure the safety and security of your personal data and privacy. We restrict access to your personal identifiable information to employees who need to know that information in order to provide services to you. We maintain electronic and procedural safeguards that comply with national regulations to guard your non-public personal information.

The security of your SolvePay account also relies on your protection of your SolvePay password. You should not share your SolvePay password with anyone. SolvePay representatives will never ask you for your password, so any e-mail or other communication requesting your password should be treated as unauthorized and suspicious. If you do share your SolvePay password with a third party for any reason, including third party promises of providing you additional services such as account aggregation, the third party will have access to your account and your personal information, and you will be responsible for actions taken using your password. If you believe someone else has obtained access to your password, please change it immediately by logging in to your account at SolvePay.com and changing your password from your security area. You can also contact us as described below.

You can review the personal information you have provided to us and make select changes/updates to such information, or to the settings on your SolvePay account, at any time by logging into your account on the SolvePay website and accessing your MY PROFILE area. You can also close your account by contacting us. If you close your SolvePay account, we will mark your account in our database as SUSPENDED but will keep your account information in our database for a period of ninety (90) days. This is necessary in order to deter fraud, by ensuring that persons who try to commit fraud will not be able to avoid detection simply by closing their account and opening a new account. However, if you close your account, your personal identifiable information will not be used by us for any further purposes, nor sold or shared with third parties, except as necessary to prevent fraud and assist law enforcement personnel, as required by law. Personal information shall be retained only as long as necessary for the fulfillment of the purposes outlined in this policy.
